WHAT IS FLORIDA RELATIVE ADOPTION?

In Florida, a family member may desire to adopt a child or adult usually done by a stepparent, grandparent, sibling, or even an aunt or uncle. Another name generally used for a relative adoption is kinship adoption. Statistically, the most popular type of relative adoption is those filed by grandparents.

Florida law has streamlined the process for relative adoptions so as to make the process much easier and expedited. The process is generally the same as for a stepparent adoption. Chapter 63 of the Florida Statutes dictates how the process is handled by the Florida Family Court.

HOW IS FAMILY ADOPTION DIFFERENT FROM REGULAR ADOPTION?

  • In Florida, relative adoptions and grandparent adoptions use a simplified set of procedures compared to regular adoptions.
  • After the adoption paperwork is prepared and filed with the court, it will look as though the child(ren) was legally born to the relatives.
  • The parental rights of the biological parents are terminated through adoption.
  • The child’s family name may be changed through relative adoption.

The steps to a Florida grandparent adoption are as follows:

 

  • File the petition. The petition is filed with the Circuit Court in the County in which the grandchild resides.
  • Include required consents. Without the consents of the biological parents, grandparent adoption is difficult, but not impossible. There are circumstances in wich family adoption has been granted, certainly the Court will take into account what is in the best interest of the child(ren).
  • Attach to the petition all required documents. These documents include the UCCJEA, Indian Child Welfare Act Affidavit, the birth certificate, and copies of any prior court orders concerning custody or support.
  • Once the case is assigned to a judge, we would help you to contact the judge’s judicial assistant to schedule a court hearing.
  • At the hearing, the judge will review the case. If everything is in order, the judge may very well grant the adoption. Sometimes, for whatever reason, a child’s biological parents are not the most suitable parents or not available to actively be the child’s parents. Fortunately, the child(ren)’s family members will come forward and wish to be their guardian angels and be able to step in and adopt the child(ren). The process of family adoption grants the relatives full legal parental rights once the Court grants the adoption. For example, sometimes the child(ren) will have already been living with the relative and/or be attached to the relative(s), while the child’s relationship with his or her parent is interrupted by death or some other situation where they are unable to care for the child.

COST OF RELATIVE ADOPTION IN FLORIDA

A relative adoption can be pricey, especially if you hire an attorney. If the parent(s) consent, it should go through the system in several months, depending on how backed up the court system is. Most of the time you are waiting to schedule a hearing with the Judge. Terminating the parental rights of both parents is effectuated simultaneously with granting the adoption usually all in the same proceeding.
